Hardship Licenses and License Reinstatement

A new state law allows more drivers the opportunity to qualify for Indiana Specialized Driving Privileges, formerly known as Hardship and Probationary Licenses. This applies to both Court-Ordered suspensions and suspensions issued by the Bureau of Motor Vehicles (BMV). The new law is discretionary with the Court and provides more flexibility and greater opportunity for a suspended driver to be granted Specialized Driving Privileges.

Eligible suspensions include:

  • Habitual Traffic Violators (HTV)
  • DUI Suspensions
  • Insurance Suspensions
  • Unpaid Traffic Tickets
  • BMV Suspensions
  • Court-Ordered Suspensions

Ineligible persons include:

  • A person who has been convicted of an offense involving the operation of a motor vehicle and causes the death of another person
  • A person who has previously received a specialized driving privilege and has more than one conviction for violating I.C. 9-30-16-5
  • A person who has refused to submit to a chemical test (breathalyzer or blood draw)
  • A person who holds a Commercial Driver's License (CDL)
  • A person who has never had a valid Indiana driver's license

Indiana law has specific legal requirements that a petition for Specialized Driving Privileges must meet. In addition, the Prosecuting Attorney may appear to make arguments against the petition. The Judge has sole discretion over whether to grant the petition and what conditions may be imposed on a case-by-case basis.

If you are the subject of a Lifetime Suspension, you may be eligible for a Full Reinstatement of your driver's license under the new law. This, however, is a different process with stricter requirements than Specialized Driving Privileges.
